7. Sale or Sharing of Personal Information

TripStop does not sell personal information for monetary consideration in the ordinary sense unless expressly stated otherwise in an applicable privacy notice.

However, certain privacy laws, including the California Consumer Privacy Act (“CCPA”), may define “sale” or “sharing” more broadly than ordinary commercial usage.

For this reason, TripStop will assess whether its use of advertising, analytics, cookies, pixels, or other technologies constitutes a “sale” or “sharing” under applicable privacy laws.

The Website does not currently use cross-context behavioral advertising, retargeting, or similar technologies that would constitute “sharing” under applicable state law. If that changes, TripStop will update this Privacy Policy and, where required, provide consumers with appropriate opt-out mechanisms.

8. Advertising and Analytics

TripStop may use third-party analytics, advertising, and marketing technologies to understand Website activity and measure the effectiveness of marketing campaigns.

The Website currently uses Google Maps and related Google location services to power the store-finder. TripStop does not currently operate Google Analytics, Google Ads, Meta Pixel, or similar advertising pixels on the Website. If analytics or advertising technologies are added, this section will be updated.

These services may collect information such as:

  • IP address;
  • Device or browser information;
  • Website activity;
  • Referring URLs;
  • Advertising identifiers;
  • Cookie identifiers;
  • General location information; and
  • Interaction with advertisements or Website content.

Where required, TripStop will provide appropriate privacy choices or opt-out mechanisms.

9. Email Communications

If you provide your email address, TripStop may use it to respond to your inquiry, provide requested information, or send communications for which you have subscribed or otherwise provided appropriate consent.

Marketing emails may include information about:

  • Promotions;
  • Deals;
  • New TripStop locations;
  • Products and food offerings;
  • Road Pass;
  • Events;
  • News; and
  • Other TripStop updates.

You may unsubscribe from marketing emails at any time by using the unsubscribe link contained in the applicable email.

Unsubscribing from marketing communications does not necessarily stop transactional or service-related communications.

10. Text Messages and Mobile Communications

TripStop may offer SMS or text-message programs, including promotional, loyalty, Road Pass, or service-related communications.

The Website does not currently operate an SMS or text-message program. If TripStop launches such a program, additional terms may apply, including:

  • Message frequency;
  • Message and data rates;
  • Enrollment requirements;
  • Opt-out instructions;
  • Help instructions; and
  • Consent requirements.

You may opt out of a TripStop text-message program by following the instructions provided in the applicable program.

TripStop will not condition a purchase on consent to receive marketing text messages where prohibited by applicable law.

11. Road Pass and Road Pass Rewards

TripStop may launch or operate Road Pass or Road Pass Rewards, a customer loyalty and engagement program.

If you provide information to receive Road Pass updates before the program launches, we may use that information to:

  • Notify you about the Road Pass launch;
  • Provide information about the program;
  • Communicate program updates;
  • Contact you about relevant TripStop promotions; and

Once Road Pass is operational, additional information may be collected depending on the features offered by the program.

Road Pass may have a separate Privacy Notice and Terms & Conditions.

If separate program terms or privacy disclosures apply, they will supplement this Privacy Policy.

12. Employment Information

TripStop may provide links to external employment and recruiting platforms.

If you apply for employment through a third-party platform, your information may be collected directly by that platform and processed according to its own privacy policy.

TripStop may receive information from such platforms for recruitment and employment purposes. Employment applications may currently be processed through Paychex or another authorized employment provider identified on the applicable careers page.

13. Third-Party Websites and Services

The Website may contain links to third-party websites, applications, social-media platforms, mapping services, employment platforms, or other services.

TripStop does not control third-party privacy practices.

When you leave the TripStop Website or interact with a third-party service, the third party’s privacy policy and terms may apply.

We encourage you to review the privacy policies of third-party services before providing them with personal information.

14. How We Protect Personal Information

TripStop takes reasonable measures designed to protect personal information against unauthorized access, disclosure, alteration, misuse, or destruction.

Security measures may include administrative, technical, and organizational safeguards appropriate to the nature of the information and the risks involved.

However, no internet transmission, website, database, or electronic storage system can be guaranteed to be completely secure.

The FTC recommends that businesses identify what personal information they hold, limit collection and retention to legitimate business needs, restrict access, and maintain appropriate security practices.

15. Data Retention

We retain personal information for as long as reasonably necessary to:

  • Provide the requested services;
  • Fulfill the purposes described in this Privacy Policy;
  • Maintain appropriate business and financial records;
  • Resolve disputes;
  • Enforce agreements;
  • Detect and prevent fraud;
  • Comply with legal, regulatory, tax, accounting, or reporting obligations; or
  • Establish, exercise, or defend legal claims.

Retention periods vary depending on the type of information, the purpose for which it was collected, applicable legal requirements, and our legitimate business needs.

We do not retain personal information indefinitely when there is no legitimate business, legal, or security reason to do so.

The FTC recommends retaining sensitive information only as long as there is a legitimate business need or legal requirement to keep it.

16. Children’s Privacy

The TripStop Website is intended for a general audience and is not directed to children under 13.

We do not knowingly collect personal information directly from children under 13 through the Website.

If we learn that we have collected personal information from a child under 13 without appropriate parental consent where required by law, we will take reasonable steps to delete that information.

If you believe that a child has provided personal information to TripStop, please contact us using the information provided below.

The Children’s Online Privacy Protection Act (“COPPA”) imposes specific requirements on covered websites and online services that collect personal information from children under 13.

17. Your Privacy Rights

Depending on where you live and applicable law, you may have certain rights concerning your personal information.

These rights may include:

You have the right not to receive discriminatory treatment for exercising privacy rights granted by applicable law.

22. Notice at Collection

Where required by applicable law, TripStop will provide a Notice at Collection at or before collecting personal information.

A Notice at Collection may identify:

  • Categories of personal information collected;
  • Purposes for collection and use;
  • Whether information is sold or shared;
  • Applicable retention periods or criteria;
  • Applicable consumer rights; and
  • Other information required by law.

For California consumers, the California Privacy Protection Agency states that the Notice at Collection must provide timely information about categories of personal information, purposes, sale/sharing practices, retention, and other required disclosures.

TripStop may provide these disclosures through contextual notices on individual forms, pages, or features rather than relying solely on this Privacy Policy.

23. Sensitive Personal Information

TripStop does not intentionally request sensitive personal information through general Website forms unless necessary for a specific and disclosed purpose.

Depending on applicable law, sensitive personal information may include information such as:

  • Government identifiers;
  • Account credentials;
  • Precise geolocation;
  • Certain financial information;
  • Certain health information;
  • Certain demographic or biometric information; and
  • Other information defined as sensitive under applicable law.

If a TripStop service requires sensitive personal information, TripStop will provide appropriate disclosures and handle such information in accordance with applicable law.

24. Financial Information and Payments

The TripStop Website may provide information about products, services, promotions, or locations.

The Website does not currently process online payments, purchases, or collect payment-card information. If online ordering or payment functionality is introduced, payment information may be processed by TripStop or an authorized third-party payment provider.

TripStop does not need to retain complete payment-card information when a third-party payment processor can securely process the transaction.

Any third-party payment provider may have its own privacy policy and terms.

25. Geolocation and Store-Finder Services

TripStop may use mapping or location services to help customers find nearby stores. The Website currently uses Google Maps and Google Places for store-finder functionality.

Depending on the functionality used, these services may receive information such as:

  • Search terms;
  • ZIP code;
  • City or state;
  • Approximate location; or
  • Precise device location where the user grants permission.

Third-party mapping services may process information according to their own privacy policies.

26. Do Not Track Signals

Some web browsers provide “Do Not Track” signals.

Because there is not a universally accepted technical standard for responding to all such signals, the Website may not respond to browser-based Do Not Track signals unless required by applicable law.

Where required by applicable law, TripStop will honor applicable privacy preference signals or provide the required mechanism for consumers to exercise applicable opt-out rights.

27. International Visitors

TripStop is a U.S.-focused business and the Website is primarily intended for users in the United States.

If you access the Website from outside the United States, your personal information may be processed, stored, or accessed in the United States or other locations where TripStop or its service providers operate.

Privacy protections in those locations may differ from those in your country or region.

By using the Website, you acknowledge that your information may be processed in accordance with applicable U.S. law and this Privacy Policy, subject to any rights that cannot lawfully be waived.
